Legal protection in public procurement procedures

Legal protection shall be provided in public procurement procedures and in the performance of public contracts. If an economic operator considers that a contracting authority has violated regulations that significantly affect or might affect the awarding of the public contract, a request for legal protection in public procurement procedures may be filed in respect of any action on the part of the contracting authority in a public procurement procedure at all stages of the public procurement procedure.

Legal protection shall be provided in:

  • the pre-review procedure, which takes place before the contracting authority,
  • the review procedure, which takes place before the National Review Commission, and
  • first-instance court proceedings, which take place before the district court.
