Notice to intellectual property right holders from Ukraine

Due to the emergence of extraordinary circumstances in Ukraine, the Slovenian Intellectual Property Office is doing its utmost to protect the rights of Ukrainian intellectual property right holders.

The emergency situation could cause patent, trademark and design right holders to miss deadlines and thus lose their rights. The current legislation does not allow for extension of deadlines (neither at the request of a party nor ex officio). However, the Slovenian Intellectual Property Office informs all interested persons that in the event of a delay in the deadline, the parties may, on the basis of Article 68 of the Industrial Property Act, request a restitution due to extraordinary circumstances, such as war.

The request for restitution should be filed within three months counting from the date when the reasons for which the party missed the deadline ceased to exist or, if the party only later learned that the time limit was missed, from the date when the they learned about it. After one year from the date of the delay, restitution may no longer be required.
