Government approves removal of encumbrances on real estate in the Municipalities of Kranjska Gora, Slovenj Gradec and Krško

At its 12th regular session, the Government of the Republic of Slovenia adopted decisions giving its consent to the removal of encumbrances, pursuant to the Agreements on the Free Transfer of State Property to the Municipalities of Slovenj Gradec, Kranjska Gora and Krško.

The applications for the free transfer of the properties were submitted on 13 January 2015 for the Municipality of Kranjska Gora, on 27 October 2014 for the Municipality of Slovenj Gradec, and on 11 December 2017 for the Municipality of Krško. The Land Register recorded, in favour of the Republic of Slovenia, a prohibition on the disposal of and encumbering the properties that had been transferred to the municipalities free of charge for the implementation of development projects, as well as an obligation to return the properties in the event of non-fulfilment of the contractual obligations. As the municipalities have completed the agreed development projects and fulfilled their contractual obligations, the Ministry of Local Self-Government, Cohesion and Regional Development, ex officio, submitted a proposal for the removal of the registered encumbrances.

The Promotion of Balanced Regional Development Act (ZSRR-2) stipulates that an agreement on the free transfer of property must also contain a provision enabling the Republic of Slovenia to request the return of the property in the event of a breach of the contractual obligations. If a municipality fails to carry out the agreed investment or achieve the intended development objective, the value of its investments is assessed, taking depreciation into account. The State reimburses the municipality for the assessed value, and the property is returned to State ownership.

Once a municipality fulfils all its contractual obligations and completes the development project, the Ministry of Local Self-Government, Cohesion and Regional Development reviews the project. It then prepares a final report and materials for the Government of the Republic of Slovenia, which decides on the removal of the encumbrance registered in the Land Register.

In the Municipality of Kranjska Gora, the development project Shelters in Tamar was implemented. The municipality fully renovated the facility of the Rateče-Planica Mountain Rescue Service. The project improved the conditions for the operation of the mountain rescue service and contributed to the tourism offer of the municipality and the region.

In the Municipality of Slovenj Gradec, the development project Renovation of the Golavabuka Volunteer Fire Brigade Fire Station was implemented. The municipality renovated the fire station and its installations, upgraded the heating system, purchased protective and firefighting equipment and a fire engine, and renovated the area surrounding the station. This improved the conditions for the operation of the firefighters and enhanced fire safety in the municipality.

In the Municipality of Krško, the development project Renovation of Two Apartments in the Municipality of Krško was implemented. The municipality renovated two run-down apartments, including their installations, doors and windows, floors, walls and bathrooms. The project helped address housing needs in the municipality.
